Popmenu Q4 2024 Sysco Partner Customer Referral Program Terms and Conditions
Effective: November 21, 2024
These Terms and Conditions (the “Terms”) apply to Popmenu’s Sysco Partner Customer Referral Program (the “Sysco Partner Program”). By submitting a referral for a restaurant, or by otherwise participating in the Sysco Partner Program, you agree to be bound by these Terms and Popmenu’s Privacy Policy at https://my.popmenu.com/privacy. The Sysco Partner Program is valid only in the United States and cannot be combined with any other offers. Popmenu employees, and resellers of Popmenu products or services are not eligible to participate in this Sysco Partner Program. The Sysco Partner Program will run from November 21, 2024 through December 31, 2024 (the “Referral Period”).
Popmenu will award to Referrer (as defined below), (1) a gift card of $50.00 for every completed bona fide live sales demonstration with a decision maker of a New Customer (as defined below) regarding a prospective purchase of Popmenu’s service (the “Demo Reward”), and (2) a gift card of $250.00 for every New Customer that has completed the bona fide live sales demonstration and signs an agreement with Popmenu (the "Referrer Reward") to any Referrer who refers a New Customer in accordance with these Terms. To qualify as a "Referrer" you must be 18 years of age or older and a legal resident of the United States and a current employee and authorized representative of Sysco. Individuals may not refer businesses that they own, operate, are employed by, or have decision-making authority over. Franchisors may not refer franchisees. Referrers cannot refer immediate family members living within the same household. Popmenu reserves the right to validate whether a Referrer is eligible to participate pursuant to the foregoing at the time of the referral. Referrers cannot refer the same New Customer more than once during the Referral Period. In the event of duplicate referral submissions (from the same or multiple Referrers), the first submission will be accepted, and subsequent submissions disqualified. Popmenu reserves the right in its sole discretion to determine the original lead source of a submission.
Rewards are subject to local, state and federal taxes, which are the responsibility of the Referrer. Referrer may be required to complete a W-9 before a Reward can be issued.
A "New Customer" is an individual or business that (1) is not a Popmenu customer at the time of the referral; (2) is not an active lead or contact in Popmenu’s records at the time of the referral; and (3) has participated in a live demo (for the Demo Reward) and has entered into a Subscription Agreement with Popmenu (for the Referral Reward), in each case by December 31, 2024. A referral must be referred to Popmenu through the online Q4 Sysco referral form (link below). Any referrals made by any other means under this Sysco Partner Program will be considered invalid. Popmenu reserves the right in its sole discretion to determine whether a referral constitutes a New Customer.
Subject to the foregoing, there is no limit to the number of referrals a Referrer can submit or Deal Rewards or Referrer Rewards for New Customers a Referrer can receive, while the Sysco Partner Program is effective. For the avoidance of doubt, if Referrer submits a New Customer to more than one Popmenu referral program, the Referrer will receive a reward only under the first of the Popmenu referral programs in which the submission was made.
Popmenu reserves the right to modify these Terms or terminate the Sysco Partner Program at any time, in its sole discretion, without notice. Popmenu’s decision with respect to all aspects of the Sysco Partner Program is final and binding.
Referrals must be submitted via the Sysco’s designated referral resource center.
