Popmenu Sizzle and Save Summer 2025 Demo Sweepstakes

4. How to Enter: To enter the Sweepstakes, eligible participants must both (i) register for the Sweepstakes via one of the methods specified below to gain entry into the available Sweepstakes draw for the corresponding Bimonthly Sweepstakes number (each, a “Bimonthly Sweepstakes”) during the Sweepstakes Period and (ii) attend in its entirety Sponsor’s bona fide live sales demonstration “Demo” held during the corresponding Bimonthly Sweepstakes time frame. Completing both actions during the applicable Bimonthly Sweepstakes time frame constitutes an entry to the Sweepstakes. 
 

Entries must be received prior to dates and times specified in the applicable table (depending on the method of entry) to be eligible for the corresponding Bimonthly Sweepstakes drawing. 
 

(a) Online Registration. Eligible participants may register by visiting https://get.popmenu.com/summer-sizzle and submitting their first name, last name, email address, phone number, restaurant name, number of restaurant locations or concepts and restaurant country location to the Sponsor. All online entries must be received by the dates and times specified in the Table 1 to be eligible for the corresponding Monthly Sweepstakes drawing. 

(b) Mail-In Registration. Eligible participants also may enter by mailing one standard 4” x 6” postcard (with no outer envelope) containing participant’s name, street address, city, state or province, postal code, country, telephone number and email address to Popmenu Sizzle and Save Summer 2025 Demo Sweepstakes, Popmenu, Inc., 1000 Parkwood Circle, Ste. 100, Atlanta, GA 30339. Limit one entry per postcard. All Mail- IN Registrations must be received by the dates and times specified in the Table 2 to be eligible for the applicable Monthly Sweepstakes drawing. 
 

Eligible participants may register only one time during the Sweepstakes Period, regardless of method of registration. Individuals who do not complete the actions necessary for registration, including following all the instructions, providing the required information, submitting the registration form or abiding by these Official Rules or other instructions of Sponsor may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Normal internet access, phone, and usage charges imposed by your online or phone service provider may apply. If you are entering and/or attending the Demo via a mobile device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. Entry into the Sweepstakes will carry over into entry into the following Bimonthly Sweepstakes drawing pools provided you are not a winner and have not been awarded a Prize during the Sweepstakes Period. 
 

5. Prize: One Big Green Egg Mini, or Backyard Fire Pit, or Patio Heater, or Yeti Cooler, or gift card, each valued at approximately $500.00 (the “Prize”) will be awarded to 1 (one) eligible participant of each Bimonthly Sweepstakes selected at random on or about the Drawing Dates as noted in Table 1 above from all eligible entries received during the applicable Bimonthly Sweepstakes. The Prize is non-transferable and non-assignable, with no cash redemptions or substitutions except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute a Prize (or a portion thereof) with one of comparable or greater value, at its sole and absolute discretion. Each winning participant is solely and fully responsible for any and all applicable federal, state, and local taxes, if any. Sponsor will report the winning Prizes to the appropriate state and federal agencies as required by applicable law. The winning participant will be required to furnish a taxpayer identification number prior to claiming the Prize. All costs and expenses associated with Prize acceptance and use not specified herein as being provided are the sole responsibility of the winning participant. All Prize details are at Sponsor’s sole discretion. 
 

6. Claiming the Prize: The winning participant will be contacted by email on or about the applicable Drawing Dates set forth in Table 1. Sponsor’s decisions as to all matters related to administration of the Sweepstakes and selection of winning participant are final. Potential winner must comply with all terms and conditions set forth in these Official Rules and winning and award of Prize is contingent upon fulfilling all requirements. If a potential winner does not meet the eligibility requirements for the Sweepstakes, does not comply with all the terms and conditions of these Official Rules, or cannot be contacted within 24 hours after the first attempt to contact such potential winner, an alternate participant may be selected in its place at random from all eligible entries received. 
 

7. Use of Data: Sponsor will be collecting personal data about participants (including, without limitation, name, address, telephone number and e-mail address) when they participate in the Sweepstakes, including by accepting the Prize. Sponsor is entitled to use personal data contained in all entries in accordance with Privacy Policy at https://my.popmenu.com/privacy. By participating in the Sweepstakes, including by accepting the Prize, participants hereby agree to all personal information uses and disclaimers as explained in Sponsor’s Privacy Policy at https://my.popmenu.com/privacy. Notwithstanding any contrary provision in Sponsor’s Privacy Policy, participants grant to Sponsor, and Sponsor reserves, the right to use any and all information related to the Sweepstakes, including information provided by participants in connection with the Sweepstakes, for any purpose, unless prohibited by law. By participating, including by accepting the Prize, participants release and hold harmless Sponsor, its respective parents, subsidiaries, affiliates, directors, officers, employees, and agents (collectively, the “Released Parties”) from any and all liability for any injuries, loss or damages of any kind arising from or in connection with the Sweepstakes, Sponsor’s websites, newsletters, podcasts or the Prize. 
 

8. Participation Conditions/Release/Consent to use Likeness: By participating, including by accepting the Prize, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of Sponsor, which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless the Released Parties from and against any and all claims, expenses and liability, including, but not limited to, negligence and damages of any kind to persons and property, including, but not limited to, invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s participation in this Sweepstakes and acceptance or use or misuse of the Prize; (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorney’s fees) arising out of or relating to an entrant’s participation in the Sweepstakes and/or entrant’s acceptance, use or misuse of the Prize; and (d) grant Sponsor the right to use and publish their proper name, photograph, likeness, voice, Prize information and/or biographical information online or in any other media in connection with the Sweepstakes, without future compensation unless prohibited by law. 
 

9. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, for any reason whatsoever, including, without limitation, fire, flood, natural or manmade epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order or regulation, public health crisis, order of any court or jurisdiction or if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in their sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any participant it finds to be tampering with the participation process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Only the type and quantity of the Prize described in these Official Rules will be awarded. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 
 

10. Limitations of Liability: The Released Parties as set forth above are not responsible for: (1) any incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the participation process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of phone calls; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of the Prize. 
 

11. Disputes/Governing Law: Except where prohibited, participants agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or the Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state courts of Georgia; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ or legal fees; and (3) unless otherwise prohibited, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with this Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules (whether of State of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia.
